How should i proceed against ex employer

07-Apr-2023 (In Labour & Service Law)
Until last month I was working with a US based start up company. My ex boss made me work 14 continuous days and asked me to come on coming Sunday too. That means, she wanted me to work for straight 21 days. When I told her that I will not be able to come for work she told me that I can't say no as it is a business requirement. Hence, I left the job. Also, she did not gave me the salary for the last month. So, here are my question: 1) Can I file a case against my ex employer for this unethical practice? 2) Is the company legally bound to give my salary in this case? If yes, how should I proceed further? Any legal advice on above queries would be helpful. Thanks for your time!

Hi
Yes, company is bound to pay u for what u worked for company. Secondly many things depend upon appointment letter and your designation in company.
Your company is also bound with company and labour laws of India.
U can contact me anytime for further guidance and yes of course we can send company legal notice followed by case in competent court.
All the very best

Hi,
The bare reading of the facts narrated by you, forced me to give you the below mention advice:-

1. In respect of act done by your employer, the best time to file suit was when your were in job.

2.In respect of salary you can file civil suit, if you are having sufficient documents to prove as to that you worked for and no salary is been proved.

Regards
