07-Aug-2023 (In Labour & Service Law)
Midterm resignation is discouraged at. If a Teaching Staff or Branch Admin for some reason decides to discontinue their employment with A the resignation letter is expected to be submitted latest by 1stFebruary and it is imperative for the Employee to complete the ongoing academic session till last day as mentioned in the calendar . A Teaching Staff and Branch Admin is expected to serve 2 Teaching months’ notice or complete the academic year, whichever is later. A is entitled to pay the Employee salary in lieu of the notice period. Similarly, the Employee can pay A in lieu of the notice period. In the event that the Employee does not provide services during the notice period or part thereof, A shall be entitled to deduct the salary in lieu of the notice period from any dues payable to the Employee. sir please let me know if there will be any legal implication if i serve only one month notice period.
Hi there would not be any sort of legal implications for non serving or part serving of notice period on resignation. Employer will recover towards shortfall of notice if any which shall be payable by employee.
