How can the company recover the bond amount

02-Jun-2023 (In Labour & Service Law)
Hi , I got joining bonus from my company with a clause in offer letter which states if i leave company within 2 years , it will be recovered back in full. I have been in organization for 1.5 years and now i have resigned because of some circumstances within team. Question : Am i liable to pay full amount of joining bonus or on pro rata basis? What is the legal time period company can specify in offer letter to recover joining bonus?

As per the recent development in law made by the Supreme Court and various High Courts, such bonds are lopsided and are not legal and enforceable under law.

You can send a legal notice to the company for asking for your dues.

If the company takes any legal action against you to ask for the bond amount, you must contest it in the court of law as the enforcement of these employment bonds is not maintainable under law.
