How can I get my relieving letter

Dear Concerned, I am working as a software developer in a company based in Gurgaon since 1 Jun 15.I got an opportunity in another company which is asking me to join ASAP. I've signed a contract in my current company on joining which says that the contract period is for 12 months and during the contract period I have to serve the notice period if I want to leave the company. So the Contract ends tomorrow. I have already asked them to relieve me but they are not listening. So I am resigning day after tomorrow without giving any notice. What to do they don't give me relieving certificate.

If your contract with the company was for a period of 12 months and you have served for that much time period then you are not obligated to serve a notice to the Company but you must duly inform them in writing of your intention not to extend the contract with them. In my opinion you should ideally not face any problem thereafter. You can request them to issue you an experience certificate for the time period you worked with them and that should be sufficient.

I dont know if you have a clause in your agreement regarding deemed extension or the contract is deemed to be terminated after one year. Reply to you question will depend on such clauses. You may like to consult by e mail with a copy of the contract.

In case your contract was for fixed term of 12 months, then you may leave the organization, however once has to look at terms of contract to see the liabilities under the same before any specific advice may be rendered to you. For more specific advice you may contact me.
