How can i file Medical Reimbursement claim of Central Govt Employee.

26-Nov-2023 (In Labour & Service Law)
Central Govt Employees are covered under CS(MA) Rules 1944. In this rules, there are various provisions/schemes apart from Govt Hospitals, Medical Attendance for outdoor/indoor viz. CGHS dispensaries and CGHS empanelled Private Super Speciality Hospitals/ Diagnostic Centres, AMA(Private Practitioners), Central Govt Recognized Private Hospitals, Medical Units of various Govt Deptts, Municipality/Corporation run Hospitals/Clinics and so many others and expenditures are reimbursable in full whatever the amount. In our area there is none of the above facilities is available within 300 km radius or more including 5 districts. We are only entitled to avail medical facility from Govt Hospitals. I want to represent the matter before Court of Law/CAT for myself only. If I get any favourable order then that will be applicable for all 600 employees of my office but nobody is interested to join with me. What to do then ?

Please take note of following -
1. You can bring this fact into the eyes of your department and organization by the way of official letter written by you to head of your department requesting him to bring this fact into the light of higher concerned authorities.
2. You can also write this fact to the Ministry of Health and Family Welfare asking them to take this issue into serious concern.
3. If none of the above steps helps you out then you may approach the court for the same. By this time, you will have some proof at your hand that instead of approaching the Judiciary you have initially tried resolving out this issue at the executive and legislature level.
In this situation Court will take a stronger approach rather than going slow over the subjects asking for the inputs from concerned ministry and then going on to deliver any decisions.

You may represent your case yourself before Court or CAT. The Court or Tribunal Order will only be applicable to the concerned Applicant or Petitioner. In other words, it will be applicable to you only (if you are the sole applicant). If others don't join your cause, it does not prevent you from standing up for yourself. Since you will be representing yourself, costs will not be an issue as well.
