Hike Payment Issue and Designation change in Payslip

Hi, I work for a US Commercial Real Estate Finance company in Hyderabad. I have resigned from my post of "Underwriting Analyst" effective 13th Feb 2019 and currently serving notice period for 2 months. My new hike of 11% on the current fixed CTC as per appraisal which was communicated to me in December 2108 was due and effective from 1st Feb 2019. The HR says as I have resigned from the company, they wouldn't give me any hike. No such clause is mentioned in the Appointment letter or handbook, they say it is general practice. Can I sue them? Also, I had been promoted to Underwriting Analyst from Senior Analyst effective 1st Nov 2018. All my payslips for Nov, Dec and Jan had the designation as UW Analyst but my current payslip for Feb mentions it as Senior Analyst and nothing about the same was informed to me. Can we sue them for this?

hi
first and foremost, you are working in private sector (information technology) and as such labour laws are not applicable. but contract act will be applicable. if you can demonstrate that you were working in the new role(underwriting analyst) since November 2018 , you are entitled to enhanced pay (11%) for month of feb 2019
