Help in filling and preparation of petition to challenge orders of CAT

10-Aug-2023 (In Labour & Service Law)
I want to file an appeal (filed in person) against the orders passed by Central administrative Tribunal. Kindly let me know What type of application is to be filed? Whether it is to be a writ petition? Under which sections or articles? Whether apart from original respondents, Central Administrative Tribunal will also be a respondent or party? Or someone may kindly forward a copy of format for filing such an application in High Court.

Dear Sir/Mam

As per your query
You can file Fist appeal before High Court. But as per the report
the Law Commission has suggested that appeals be filed directly in the Supreme Court and not in the High Court.

Chandrakumar’s case

State and Central Administrative Tribunals were constituted pursuant to the 1985 Administrative Tribunals Act. As per this Act, appeals against the tribunal orders could be filed directly in the Supreme Court. However, after the judgment in L. Chandrakumar’s case in 1997, appeals would have to be filed first in the High Court concerned and then before the Supreme Court.

To prepare draft of Appeal documents required. you may Contact me for further consultation.
Thank you

Dear Client,

Your query is not in details . You may discuss the same with the order of the CAT in your matter and how to go about it for appeal. This will also require to take help of any advocate to make your appeal and you may then file in the Court.

You may contact me for further advise on the matter with all relevant documents/judgements for further course of action.

Regards,

HS Verma
