Grounds for getting the gratituity after working for 4years 10 months
14-Aug-2023 (In Labour & Service Law)
Hi, I will complete my 4.8 years on 17th Aug 2017. My date of joining is 17th Dec 2012. Please let me know if I am eligible for gratuity. I will be serving my notice period of 2 months till 18th Oct. so total no. of years worked with present organisation would be 4 years & 10 months. My organisation says I have to mandatorily complete 5 years to get eligible for gratuity and in the 5th year there should not be any leave taken. I have taken 7 leaves in this running 5th year until now and all were paid leaves. Please help if I should get gratuity or not.
You have to complete 5 years in an orgaisation where you are working to get the Gratuity. So you are not eligible to get the gratuity as you have completed 4 years 10 months and not 5 years hence you will not get the gratuity.
