Grievances of contractual staff outsourced through private agencies

We contractual staff outsourced through private agencies in Ministry of Health and Family Welfare, we get a mere remuneration of Rs 11000/- and Rs 10000/- respectively. Last year both outsourced agencies were sanctioned bonus amount to distribute to contractual staff duly approved and concurred by AS & FA. However, only the outsourced Staff of Balaji security services received bonus at Diwali and Outsourced Staff of Sybex Computers didn’t receive any bonus at all.Now a critical situation arises because there is a recovery of bonus amount from Outsourced Staff of Balaji security services. can it happen?
No. Technically this is not permitted as per the law and you can flag this to Labour union of your state and they will take care of it. If in case you do not want to politicize this subject then you can take the legal recourse. First by sending them a legal notice and then by dragging them before the competent court of jurisdiction.

No they cannot recover the bonus disbursed as the same would be discrimination between the contractual staff. If you are employees of the ministry then you may immediately prefer a writ petition and seek a stay, otherwise you may file a petition under the industrial disputes act with the labour commissioner.
