Gratuity denied by the employer for minimum eligibility criteria in go
18-Nov-2024 (In Labour & Service Law)
I had worked in an government organisation in continuous period for 4 years and 240 days ,but the employee denied the payment of gratuity saying that minimum 5 years of eligibility for gratuity, need clarification for minimum no of years and days criteria for gratuity
Two exceptions allow for gratuity eligibility before the five-year mark:
— Termination due to death or disablement: Employees are eligible regardless of service length under these circumstances.
— The 4 Years 240 Days Rule: Employees can qualify with just four years and seven months of service under certain conditions.
