24-Sep-2024 (In Labour & Service Law)
my gratuity claim is pending at Labour authority managment says that we will give you the pdc cheque of 2 months amount is 45k else you can go for the order of recovery. Now I have 2 questions, which one is batter to take the PDC cheque or Recovery order. and can employer challange the recovery order by filing the appeal. where they can file the appeal, kindly answer
In your situation, you can either accept the post-dated cheque (PDC) of ₹45,000 or wait for a recovery order from the labour authority. Taking the PDC ensures that you receive some immediate payment, though it may not cover the full gratuity due to you. However, if you believe the amount offered is insufficient or not in line with what you are legally entitled to, it would be better to wait for the recovery order.
Regarding challenging the recovery order, yes, you can do it.
