Gratuity Claim Entitlement if not completed 5 years
02-Apr-2023 (In Labour & Service Law)
I have worked in an organization for 4 years 7 months and was asked to resign. Am I entitled for gratuity? Gratuity benefit is part of my CTC.
Regards
more details are to be required special about the organization . Normally gratuity can't be withheld . Need to know about the contribution of the organization . Gratuity should be paid off within stipulated time
For eligibility you need to be in continuous service for not less than 4 years 240 days. In case you have been asked to resign, it is hereby presumed that you have not been served any showcause notice neither you put any words or sentences in the resignation letter that will amount to forfeiture of the gratuity amount. Please apply for the same to your HR, normally companies settle their due in full and final settlement. So please wait, in case your gratuity amount doesn't reflect in the full and final settlement, better to apply for the same then!
