Gratuity after 4 years 10 months

Hi,
I've resigned from a software company after serving 4 years 10 months with no interruptions on February 2020. The company refusing to pay me gratuity citing I've not completed 5 years. However the gratuity act says 240 days can be considered as an year. How can I legally raise the issue with the company?

An employee completes 4 years and 6 months of continuous service in the same establishment, he is eligible to get gratuity as per the Payment of Gratuity Act 1972.
So, its not upto the Company to reject this anymore as you are eligible.
