Government Servant Salary Withheld for refusing promotion

need a law guidance (my father had promoted in 2015 from to different location but that time due to health reasons he gave an application for refusing promotion and continued in the same post and till 3yrs it was fine but from FEB 2018 They held his salary giving d reason for rejecting promotion we r suffering for not having salary for 8months what can be done pls guide us. It was there mistake as they have nt sent application of rejecting promotion to concerned officers.
Its grave erroneous act of the department for holding salary on grounds of promotion offer rejection though your father has served for 3 years thereafter. So please consult us to file a petition in Administrative tribunal to reinstate the salary along with arrears and interest.
