Government employee suspended from service, steps to be taken now

A Government employee suspended from service for more than 2 and half years, sought remedy through Honble High Court of Madras. The court passed the order as below: “ Be that as it may, it is open to the petitioner herein to submit a representation for revoking the order of suspension to the respondent within a period of two weeks from the date of receipt of a copy of this order and the respondent, on receipt of the same is directed to consider the said representation on merits and in accordance with law and pass orders within a period of four weeks thereafter and communicate the decision taken to the writ petitioner”. Whether the above order sets aside the suspension order and entitles the employee to be reinstated into service.

Sir,
The above not setting aside the suspension order instead it directs the respondent government to consider the claim of you on merits.reinstatement will not be automatic by this order.Goverment may also reject your claim.

As per the order the respondent has been asked to consider your representation and take necessary action according to law .No where it is mentioned that the set aside the suspension and re-instatement.
