Full and final settlement due how can I recover it

30-May-2023 (In Labour & Service Law)
Hi, I have worked for a MNC for more than 3 yrs in Gurgaon. I am facing issues in Full and final settlement and would like to know what action can be taken? I resigned on 10 feb, 2016 and 16 Feb was my last day at work. The first issue is that they are not paying my yearly bonus which was RS 37,000 which was mentioned in my appointment letter. My appraisal cycle was Jan 2015-Jan 2016. They always delay their appraisal and payment process else it should have been paid on 1 feb, 2016. They ask me to pay for notice period which was not in my contract that's 2 months.

You should point out the relevant clauses from the contract and give them an opportunity to correct. Else you can approach the Labour Inspector and lodge a complaint with him in respect of the your unpaid dues. That is the fastest and the most effective remedy available to you. You should also have them sent a legal notice if they do not pay heed to the letter you send. A complaint against the Company and its directors could also be pursued.

Going by the facts given by you apparently you have a good case for getting all your dues and the appraisal as well. In case you want to proceed legally against the employer the case will have to be discussed personally along with the agreement.
