Fraudulent and Legality of trade union

15-Jan-2023 (In Labour & Service Law)
If a trade union is registered with the Registrar of Trade Unions in year 1995 with exactly the same name of another trade union which had earlier prior to 1995 participated in wage negotiations with employer then whether the union registered in 1995 will be termed as illegal/fraudulent. What will be the consequences of the agreements signed between this union of 1995 and the employer and whether they will be treated as null and void. Please advise proper line of action.

frm your information it seems that first union was not registered one and the second got registed with the registrar of unions. the first negotiation agreement with the employer will not get frustrated, But it will prevail till no fresh negotiation happen between the new registered union and the employer.
Registered trade union and unregistered trade union do not matter the thing matters which one is ha v ing fresh negotiations if the office bearers and members are not same.
However now one thing is certain that the old one unregistered union now can not register itself with the same name for same commercial venture i.e.factory.
