Former employee not releasing FNF

Former employee not releasing FNF inspite of several reminders worked in the organisation for 2 months and notice period mentioned was 2 months but employer allowed to relieve in 1 months. now they sent a letter mentioning salary will not be released due to non service of notice period. please guide
This is my response to you:
1. The employer has cleverly tricked you into buying out your notice period and therefore seeks the right to retain you salary;
2. If you gave no formal communication to buy out the notice period then you are not bound by it;
3. Send a legal notice to him;
4. Also ask for compensation or you will take further legal action;
5. Consult a local lawyer and send a legal notice as first step;
6. Most probably you will not feel the need to approach the labour court.
