Foreign bank selling business to another Indian bank pending my civil
01-Jan-2023 (In Labour & Service Law)
I, an ex-employee of a Foreign Bank in India, has filed a civil suit for wrongful termination in 2015 and my case is quite strong. It is now at evidence stage and issues are already framed, documents submitted. Now, I learn that Bank has since sold its business to another Indian Bank in India and would exit from India. Can I get a stay order from Court on this sale process as recovery of my dues upon court decision would be difficult if bank is allowed to exit. can we involve RBI also and get an order to stay their exit/lien on capital transfer from India. Please help and guide me.
Firstly without looking into nature of case and studying file nothing can be suggested here, dont worry about take over company even they owe liabilities of past transactions and you can shift burden on them by making them party to suit and stay application can be filed but you have to proove how its affectinh your prayer or relief sought.
