Extortion by the employer and salary denied

15-Sep-2023 (In Labour & Service Law)
Hello sir/madam I was working with TImes Globacom pvt ltd in India, Delhi. They didn't pay my last 2 months salary as i was terminated on 22nd feb,2016 by the employer without the prior notice and being told that your full and final settlement will be done in 45 days. Now its september and they are denying to pay my salary and they are saying we will not give you the salary. I am doing regular follow up through emails and calls as i was not in delhi, still there is no reply from their end. I was promised that my salary would be transferred with 45 days from the last day of employment which was 22nd Feb 2016. So advice me what to do under this regards. I have the following documents:- 1-mail of appointment 2-mail of termination 3-account details 4-one of their channel partner and few employees to verify my statement.(witness) 5-and few more employees facing the same.

You should immediately shoot them a legal notice asking them to forthwith release arrears of your salary and also advance salary for firing you without any notice. In case they fail to ventilate your grievance despite the notice, you may you seek your claim by filing a case before the labour commissioner or by filing a suit in civil court. What remedy you have to choose either of the two will depend upon the position you were holding in this co.
