Ex employer is not issuing experience certificate what can I do

Dear Sir I worked with software company, when i left in 2011 they issued relieving letter, at that time I didn't know what is experience certificate but now i am in US and my current company is going to process green card. As per GC requirement i need experience certificate with skills and responsibility. I requested to my employer and i am struggling since 2 months neither they are issuing nor they denying for the same. I need your expert advice, what should I do ? Is there any legal way to get experience certificate in India?

Your case seems like merely a case of procrastination on the part of your ex-employer. Ideally you should be able to get the certificate from them by putting a little pressure on the concerned person but if you left the company by following the proper procedure and serving out the notice period as required they should not withhold the experience certificate. But having said that there is no law that binds the employer to issue an experience certificate.
