Employer not relieving me after I resigned

I have resigned recently and i am in notice period. In my Employment Agreement in Appointment Letter it is mentioned that employment termination notice can be given by either side for 2 months or in lieu of salary therefore. I have put my resignation due to medical reason and asked my HR to give me option to serve 1 month and buyout or compensate the other month. HR is not agreeing to it and forcing me to serve 2 months. They are saying that I am not eligible for Buyout option.What can be resolution to this issue.

Send legal notice stating that, what are mentioned in the offer letter and appointment letters. After not paid any salary or reliving letter , the file a appropriate suit and seeks compensation for loss of future earnings and others. Consult and get relief.
