Employer Not Paying Incentive in FnF Settlement
26-Oct-2023 (In Labour & Service Law)
Dear Sir,
Mr. Arijit Said branch mapping is not done.
Reason 1: Branch mapping is not my part, What ever given branches I worked and sourced business more than 150% and Attached proof of the document received as Strategy team.
Mr. Arijit Said you are eligible for July and Not eligible for August.
Reason 2: July month I does not achieved my target of 100%. So, That he said like that.
Mr. Arijit Said Your local conveyance paid for the month of July and Pro rata basis for the month of August.
Reason 3: Your people are not processed directly, I fight for that almost 1 month, then only I received.
Note: If you are not having Branch Mapping Data, Then how you are processed my local conveyance amount, It is linked with Target vs Achievement.
Mr. Arijit talking about Tnc ...
As per EPF Act 1952: Employer has to pay 12% of Basic salary and Employee has to pay 12% of Basic salary. But why are you taking 24% from our Salary.. Where did you mentioned in the Offer Letter.
hi
First and foremost employer cannot deduct 12% of his contribution from employees salary. i think your Employer is having the wrong practice of adopting cost to company formulae whereas under law, he should follow gross salary principle whilst paying 12% EPF contribution by employer.
W.r.t performance linked payments you should issue a legal notice and pursue legal remedies in civil courts.
Please note , non payment of salaries will come under labour court jurisdiction whereas performance linked bonuses, full and final settlement etc will come under civil court jurisdiction.
