Employer Delaying The Relieving N Experience Letter On Purpose

18-Aug-2023 (In Labour & Service Law)
Hi Iam working in Bengaluru in a startup for last 4 years. I started of with a pay of 8000 per month and after 4 yes I reached close to 35000 which is much less by industry standard where I'm in. I also have financial problems n domestic problems on my home front. So last month I got an offer from a new company who need me to join there by next week of August around 23 Rd. But my employer is delaying my relieving n experience letter in a bid that I lose my new offer. I don't want that to happen.. Also since January 2017 the salary payment by my current employer is not uniform some moths pay cuts were there four months the no salary atall. What can I do is there any legal action that I can take against my current employer so that I get my payslips n relieving n experience letter in time. Thanks

Issue legal notice to him by explaining the inconvenience caused by them and ask them to provide the same immediately after receiving of notice otherwise you will be constrained to take legal action against them. Contact advocate to do the needful and convey the same through e-mail to them that you are going to legal action against them for causing unnecessary inconvenience which may make you to loose your new job.
