Drawing salary from employer for suspension period

09-Jul-2023 (In Labour & Service Law)
I was suspended and chargesheeted. The suspension continued for approximately 190 days. The suspension was not reviewed by the review committee. In fact no such review committee was formed. After suspension, a major penalty was imposed on me which was challenged by me and that was altered. Two charge memoranda was issued during the period of suspension which was duly replied. I was paid the subsistence allowance during suspension. Can I challenge the suspension now and get full salary for the period of suspension and also to treat the period of suspension as the period on duty?

Yes you can do that. In fact you can also sue them for the disrepute which has come to you due to this event seeking heavy compensation from them. If you are confident that the charges imposed upon you are wrong and your case was not managed or probed as per the norms then please go ahead and contest it with your full force and prove yourself to be a right person in front of all.
