Does the clause restrict me from joining a role of other job profile

15-Jul-2023 (In Labour & Service Law)
Hello, I have been offered with a role at my client company but the job profile is other than what my current role is at the client place. Now my current employer has mentioned that I cannot join the client due to the below Employment TnC clause: 1.1 You agree that you will not, without the prior consent of the Company, either during your employment (except in the proper performance of your duties) or at any time during the Restricted Period, either on your own account or on behalf of any other person, firm or company (in any capacity whatsoever) directly or indirectly: 16.3.1 (i) solicit, or (ii) assist in soliciting, or (iii) accept, or (iv) facilitate the acceptance of, or (v) deal with the custom or business of any Client or Prospective Client in relation to Restricted Work in competition with the Company. Now my query is: Does this clause restrict me to work for the client even if the role is not pertaining the service which my current company offers to the client?

This is my response to you:
1. If you have signed the bond then you are bound by it;
2. You must consult a local lawyer show it to him/her;
3. Only after reading the terms and if there is any loophole then only best advise can be shared with you.
