I was dismissed for some operational lapses in issuance of bank guarantees resulting in fraud. In the dismissal letter , the loss is not quantified but mentioned that financial risk is caused to the bank. The appeal to the appealant authority did not yield any result and disciplinary authority's order became final. I think the punishment is not commensurate with the offence and is too harse. I would like to file a petition in kolkata high court against the order of the disciplinary authority and appellant authority.
Before suggesting any legal recourse please answer the following:-
1. Is the bank a Government Bank?
2. Was you given an opportunity of heard?
3. What about the charge sheet?
4. Was an enquiry officer engaged or the immediate supervisor was dealing with the investigation?
5. You have stated there was some operational lapses! This has to be briefed.
6. Aside need to go through all the documents even for a proper analysis and legal recourse.

Issuances of Bank guaranty is not one's individual responsibly . The employee cannotbeaccountable for such .Without proper procedure dismissal letter cannot be issued . However rest could've explained only after scrutinizing all papers
