Delay in financial settlement by ex-employer. How to retrieve my dues?

07-Mar-2023 (In Labour & Service Law)
I have changed my job 8 months back. My ex-employer has released a small part of my financial dues but is non-committal about the incentives that are pending since 2013 September to 2016 March (I have the calculations done and had sent across to them long back). They are resorting to delaying tactics. What should I do to retrieve my dues?

Hello,
So long as the payment of these incentives are not discretionary on the part of the employer, you have a right to receive the same and the employer is under an obligation to pay the same to you. I would suggest that you send a formal letter to your employer claiming your dues, setting out a date by which all your dues should be paid. If the employer fails to respond to the same, a legal notice may be issued on your behalf to your employer calling upon the employer to pay up the dues.
