De registration from EPFO of my newly incorporated OPC

09-Mar-2023 (In Labour & Service Law)
I have formed new OPC(One person Company). At the time of incorporation the company was registered under PF by the Consultant who was incorporating the company. My company(OPC) will hardly have two -three employees and they are not willing to deduct PF. As I am not reaching the threshold of number of employees I was free from all the compliance. Can I de-register my newly incorporated company from PF. I have no employee yet in the company.

You are not within the threshold limit of EPF. Even though if you have registered, you have to move an application before the learned pf Commissioner for its delisting. Please note that under pf there is no provision for this and will depend upon the discretion of EPF commissioner. Probably you may have to approach the High court for necessary orders.
