Contempt Application in Delhi High Court dismissed with defect. Remedy

17-Oct-2023 (In Labour & Service Law)

Sir, The Division Bench of Delhi High court in a writ passed an order in favour of me. The Ministry took one year to issue an Adm. order 1n 24th Dec 14 in its own way by ignoring the verdict of court. Then a contempt Appl. was filled in High Court by issuing a legal notice in May 15. The High Court returned the file on 3rd Sep.15 indicating some defects. Since then my Advocate is keeping the file and taken no action. My Question is 1. Can I change the Advocate at this stage? 2.will there any problem of limitation in this case at this stage?

Dear Concerned,

You can change your counsel. However, it is advisable to inquire from him the core issue behind any omission on his part. in so far as limitation is concerned, the same shall not come in your way as the period is one year from the date of contempt complained of and in any case, your contempt application stands filed in the Court.
