Consequences of not disclosing the last employer

17-Sep-2023 (In Labour & Service Law)
I had worked in a private IT organization for less than 3 months and would like to omit this experience. I had not left the organization on a very good term (though I have the service certificate from them with conduct as good) and am concerned that they may provide negative feedback in background verification by a future employer. However, as I need to provide my UAN number to prospective employer I think my employment history can be found by that as the last organization had deducted some PF amount also from my salary. Please advice what would be right here ? To include this employer in my experience or to remove it? RIght now I am not working and looking for a job so need to tell the prospective employers accordingly. Kindly advise

This is my response to you:
1. You will need to disclose the earlier employer;
2. This could affect your new employment;
3. The employees code of conduct has rules wherein if you suppress information then you could be terminated without inquiry;
4. So therefore do not risk it;
5. Consult a local lawyer and let him read through your appointment letters, labour bonds etc.

My Response to your query:

You have to mention that you worked in one company for 3 month. Reason for moving you may place as per your convince. By the way previous company will not give the negative response because you just worked for 3 month.

If you hide the said fact it will come before you in future definitely.

Thank you
