Company refuse to pay my 4 month salary by saying they don't have mone

My company refuse to pay my four month salary to no reason just by saying they don't have money. But they still successfully commencing their company. I have my offer letter, appointment letter, experience letter, and receiving letter with me. What should I do now. And if I go to labour court, how much time it take to take out my salary from company?

Time consumed in litigation differs from case to case; the circumstances and factual position counts too much in litigation. tHerefore it is very difficult to calculate the time that would be incurred in getting an award from labour court. Usually it takes at least 6-12 Months in getting an award from the labour commissioner. As a primary step you should serve a legal notice to your employer raising demand of your outstanding salary.

Hello sir. I have perused your query. At the outset you can send them a legal notice seeking clearance of dues in addition to interest with cost of notice. Depending upon your salary and other considerations. We can file a summary suit or we can invoke our remedy under the insolvency and bankruptcy code, 2016. I can tell you the time once i see the documents, but if we have all the documents then it should not take over 6 months to one year.
