Company promised hike but denied later what can i do

I got an offer new from company and I put resignation to present company. present company offered some hike. I told to new company they told will give a hike and not to take back my resignation so I did not took my resignation. I waited for more than a week but they are not giving my updated offer letter. mean while my increments and promotion also gone and now they are offering even less than what they have told and I cant take back my resignation as I will not get any increment and promotion. I have all the all the communication related to this is there with me. any legal action can be taken

It depends on whether you had received the Offer Letter / Appointment Letter or not. You cannot claim the position  from the company, however you can claim compensation for the losses or damage incurred by you due to the said offer.

 

You shall have to file a suit for damages and compensation against the company and you can take action on the following grounds:

 

i. Loss of employment as you had already resigned from your earlier job and obtained an NOC as well, with respect to the job.

 

ii. If any agreement was signed then breach of contract. In case of no contract, you can also bring the ground of promissory estoppel.

 

iii. Loss of livelihood.
