Company not willing to pay for maternity leave what can I do.

08-Dec-2023 (In Labour & Service Law)
Hi, My wife is working for Optimum Infosystem and she has been deployed at client site (Credit Suisse, Pune). She is working as contractor for Credit Suisse and on permanent payroll of Optimum Infosystem. As the days for maternity leave coming together they confirmed they will not pay for the maternity leaves. Instead asking to loss of pay for 3 months. Do we have a case here? If yes then against who? Payroll company or Client?

Dear Mam,
First of all You have not mentioned about the institution you are working with but as per your 7 years of working you should have been granted minimum 6 months of maternity leave with pay at first instance and same on second also.
Kindly first complain about the whole matter to the concerned DEO and also to the labour department as well and thereafter you can file court case.
