Company not paying Gratuity n Full n Final settlement since Dec. 2015

- Pancard Club (Panoramic Group) is not paying my Gratuity, Salary and Full n Final Settlement since Dec. 2015. - I had approached Labour commissioner, but the said company didn't appear at labour commissioner office. - Company is facing legal issues with SEBI as the company were running CIS scheme as per SEBI and SAT. - SEBI is selling company's and director's properties to recover investors money - But as an ex-employee i am not getting my dues. What are the chances of getting my dues, what is the procedure, how much time it would take and what is cost for the same.
This is my response to you:
1. The company should have appeared at the labour commissioner's office;
2. If they don't appear then ask for ex-parte order;
3. That ex-parte order can be useful for you later on;
4. Now since the company is gone under liquidation find the OLR and file an application/form for your claims;
5. The OLR office can be found on the Bombay High Court website;
6. When the company's assets are being distributed you will get your dues.

As you had filed the matter before labour commissioner and company didn't appear there then the commissioner might have already referred the matter to the labour court and if not referred then request him to refer the matter to labour court soon. Once the matter is sent to labour court then you can fight the case against the company there. It takes at least couple of years to get result from the labour court but in the meanwhile once the company appears there then you can have a chance to amicably settle the case by way of one time compensation amount.
