Company asks to pay 3 month's salary to return original documents

Hi Sir/Madam I submitted my original documents to the third party company at the time of offer they said they will provide it after one month after verification. I joint to their client company on 02May and was not able to adjust because of the timings So I talked to the third party HR they said u got no option you have to serve three months notice or pay the salary of three months but the thing is I didnt signed any bond and that I wasn't having so I got afraid n got to work but when the client asked me about it they understood and released me from the duty. Now the third party is just telling me to pay the three months salary or else the company won't provide me with the certificates. I told them give me other client to serve my notice period but they ain't listening and just telling me to pay up? What should I Do?

Dear Client,

Your statement is seems to be indicating that you got the job through third party or consultant who is asking you 3 months salary. You should read your appointment letter and its terms and conditions and if it has the clause of 3 months notice , then you are required to do so.

This is my response to you:
1. If you have not signed any bond then you nothing to worry about;
2. If there is nothing mentioned about notice period in your appointment letter then nothing to worry about;
3. Have they sent you any legal notice to claim dues?
4. If they have sent legal notice then you reply them that there is no bond or mention of notice period;
5. Maximum they may file a suit for recovery (less likely to happen though) or blacklist you (again less likely);
6. You must send a legal notice to them to retrieve your original documents from them;
7. If they don't then they are in illegal possession of your documents and itself amounts to theft;
8. Waive off your salary and compromise and retrieve your documents from them.
