Class 3 company quarter given to class 1 employee, is it legal?

Dear Sir / Madam, I joined  Insurance Co. as class 1 Officer in August 2014 in Mumbai and had applied for Company quarters for residence since day one. Since no company flats were vacant I was offered rental Lease option where the company paid me rent as per GIPSA guidelines. However, recently the estate department said that to bring down management expenses they will not pay rent and will accommodate me in flats which have been marked for class 3 employees (substaff and assistants) for years. I felt humiliated and discriminated (no officer was ever told to stay in substaff flats in any PSU ever). They have offered this to a group of class 1 officers like me who were awaiting for flat accommodation since past 3 years. Since they are offering to more than 1 person i am afraid they might rule out discrimination. My question is How do i proceed and is there any section of IPC which says anything against this decision and restore me my justified rights?

Indian Penal Code, 1860 comprises of the criminal offences done within and without the territory of India. However, if there is discrimination on the basis of caste, race, gender or religion, then you can approach jurisdictional labour for redressal of your issue.
