Can the revisionary authority's order be challenged in high court
30-Jun-2023 (In Labour & Service Law)
sir. I was dismissed from railways after the departmental inquiry in 2009 and filed a criminal case in 2009 for misappropriation of railway cash. the appellate authority confirmed the same in March 2010. I submitted revision application to general manager on 10.4.2010. but not disposed of. the honorable criminal court acquitted on 26.2.2016. again I represented for reinstatement. but no reply. then honourable CAT directed general manager to dispose my representation. the general manager confirmed the same punishment vide its order dated 31.1.2017. due to my financial crisis so far I did not challenge the order in CAT I am due for retirement on 31.7.2017. only one month remaining. kindly advice whether at this stage to go to CAT or high court. thanking you sir
it is better to approach the Hon'ble High Court under article 226 of the Constitution of India to file a writ petition for reinstatement and back wages. the High Court may then decide whether to consider your petition or not and is there any merit in the case and order accordingly.
