Can salary be claimed in case of resignation before notice period
07-Jul-2023 (In Labour & Service Law)
I was working as PGT CHEMISTRY in punjab in private institution and I have signed an contract that I need to serve 2 month notice if I resigned or to submit the salary of two months. In April I have got the government Job ( interview held in 2015) and resigned from the post on 24 th April 2017. But due to joining in government Job, I have left the institute on 30 April. Now can I claim the salary for the Month of April and one month security (deducted at the time of joining) Please Suggest
You cannot claim your salary for two months as according to the contract terms you need to inform the employer 2 months before. Such clauses are there in the agreement because employer should know when are you leaving and he can arrange another employee in your place. Hence you can only request or negotiate with your employer
