Can my company deduct 40 days salary if I resigned for not being paid?

I have been not paid for last four months. so due to financial issue i resigned from job without serving notice period. but now they are deducting amount that equal to 40 working days salary. dose they have rights to do so. bcoz they have already not paid my salary for 4 months. This 40 days salary deduction point was mentioned in offer letter but they was unable to pay even in notice period so serving for another 40 days without salary was impossible to me. considering all this point legally are they have any rights to cut down notice period amount

Recovery of salary is one issue. For recovery of salary you have to file court case. Unless notice period is waived, notice pay is deductible. Your relationship however is governed by contract of employment.
