Can I send a legal notice to my Employer for Releaving letter

Hello Everyone.  I submitted my resignation on 20 Sep saying that 30th Sep will be my last working day. But HR said that he ready to re-leave but CEO does not wants me to re-leave. The notice period time was 3 month and I am ready to pay for buy out but still they are not releaving me. Kindly suggest.

Please take note of following -
1. You should initially try to solve out this crisis at the management level of the company itself.
2. Since 30.09.2016 has already been passed and it seems your issues are yet to be resolved you may send them a legal notice asking you to relieve from your job and responsibilities when you are ready to go for the buy back policy.
3. Company do not have any right to restrain you from leaving the job and responsibilities if you are ready to serve the notice period or instead of serving the notice period going for the buy back policy.

To answer your quary properly you have to show us your appointment letter as well as agreement signed by you at the time of joining. You also hv to show us your resignation sent by you to your employer

As per existing Industrial Law, normally a notice for a period of 30 days is required for a permanent workman or a probationer for submitting his /her resignation or he/she has to pay 30 days salary in lieu of that. I think there should not be any problem for your company to relieve you. However you are advised to give me the full details of your case in order to enable me to advise you properly.

Hi, will glad to help you. Send them a notice asking them to hand over your relieving letter through a lawyer and if they don't reply file a case before your district court. It will not take more than 6-8 months.
