Can I file writ petition to get equality in Pay Scale

01-Apr-2023 (In Labour & Service Law)

Sir, i m working as ASI/Physiotherapist in BSF(Home ministry). they appointed me at pay scale of 5200-20200 + GP 2800. But according to sixth central pay commission the pay scale for PHYSIOTHERAPIST is 9300-34800 + GP 4200. The work profile and eligibility criteria is same. Can i file a writ petition in High Court to get similar pay scale for similar work.

if the grade pay is already notified by the central government and the people are getting the same it can be asked by way of filing a writ petition. Some points are to be asked through RTI. according to the designation and work profile equal grade pay can be demanded.

Hello,
As per your query i would like to suggest to raise a representation before the authority concerned regrading your grievance and if they do not turned up to satisfy your grievance then you could approach to the HIgh Court for the relief you claim by filing a Civil writ petition. rest of your query will be better answered when we discussed on air.
