Can I be terminated from my job during my probation period

My wife filed dowry case under ipc 498a on whole family. my brother got job a month before the case filed. he has only 30 days attendance on his job. but after case he is absent from job for 40 days.now after bail he went to department for re joining on job. but dept said he is in probation period and he may be terminated from job. is it possible? he is not sent to jail even for a minute.plz help
We suggest that you should send a legal notice to the employer thereby specifying said facts and further state that the termination would be illegal and hence you should be compensated for the same.
In case they fail to reply, then you can file a suit thereby demanding compensation
