Can ex employer sue if declaration signed at time of job is violated

My ex company made me sign a declaration mentioning -I cannot join a compititor for next 6 months on the last day of my release which was followed by the required handover etc. This clause was mentioned in our appointment letter as well. However it has only been few days since my release and I have a good offer from a compititor.Can my employer do any kind of case if I join a compititor?

Yes, he has all the rights to sue you. As you have violated the terms of agreement so he can file the case in the civil procedure code as well as contract act can also be invoked here. As per the recent development in law made by the Supreme Court and various High Courts, such bonds are lopsided and are not legal and enforceable under law.

You can send a legal notice to the company for asking for your dues.

If the company takes any legal action against you to ask for the bond amount, you must contest it in the court of law as the enforcement of these employment bonds is not maintainable under law.
