Can an organisation reopen a case about LTC after five years
15-Aug-2023 (In Labour & Service Law)
I visited somewhere in the country on LTC during 2013. claim submitted and passed accordingly. Now my office is going to reopen the case due to air fare. Can office do that after 5 years expiry of the case?
Yes ,in case of Superannuated employee any issue can be revisited within 4 years of superannuation and for on the roll employee any time during the currency of employment , Employer can open/reopen any issue based on audit report or vigilance report or any complaint received from verifiable source.Should legal assistance is required contact me through lawRato.
Yes of course the Company can do open any case of 5 years older. The reason is that there is no law in this effect at least now. The fact of the case fully depends upon the employer and the policy of the Company!
