Can An organisation refuse to accept resignation
18-May-2023 (In Labour & Service Law)
I am a cabin crew , since iam medically unfit to fly I wanted immediate release from the company so that I can get my treatment done. However, they are threatening me that they will not accept my resignation unless I serve notice period doing any random ground job they will ask me to do. I do not have any consent for that. According to the contract papers, it is mentioned that I have the option to pay the basic salary in lieu of the notice period. However it is mentioned it can insist on the notice period. They are not even accepting my resignation unless I commit to serve the notice period. I did not sign up for any job role that they will make me do. They said I do not have choice. What should I do?
It’s a right of an employee to resign from my company and no company can compel you to work there. The best the company can claim is the salary for notice period as per its terms and conditions. You can resign and claim for your full and final settlement. For any further legal assistance please feel free to contact

A company cannot compel any of its employees in such circumstances. The best they can do is that they can deduct your salary for the notice period or for any period of your absentees. You can also claim your full and final settlement from the company after the resignation.
