Can a Stay order be put on a notice issued by office.
29-Nov-2023 (In Labour & Service Law)
This is Mr Vinod Shekhar, aged 57 from lucknow.
I am working as a central govtt employee in of the central government colleges in Lucknow, which has its fully fledged campus (quarters also). Because of some kind of nuisance(fight) created by a person in the month of feb 2019 in which i was the victim, i reported the same to the management, for which we both were issued warning letters that another such act would let the management take strict actions on both of us.
Unfortunately that happened, there was again a feud in october 2019, with the same person and because of that person only.
This time the management(CEO) asked both of us to leave the campus(Quarters) where i have been staying for more than 30 years as of now. An electronically generated notice signed by the ceo of the campus has been given to both of us for vacating the house within 1 month.
I have around 3 years of service left, and my own house is not constructed fully. Is there any way to put a stay order over that ??
as you are saying that you are a central government employee then your case will be filed before cat i.e. central administrative tribunal. getting a stay depends upon the view of the court and the relevant rules and regulations of your department like whether that CEO has the power to issue such orders, etc etc.
