Can a labor ask for wages under Wages Act

A mason who has built a kitchen in a private residential house. can he file a claim of wages under section 15(2) of payment of wages act read with section 45 of the building and other construction workers regulation of services act?
First he should make a complaint to the concerned labour commissioner. Before going to court, and further it depends on the evidences which he has in order to claim his dues. His problem will be solved before the commission.
