Can a employer take action if i don"t serve notice period
03-Nov-2023 (In Labour & Service Law)
I have joined one co. & left within 4 days and submitted my photocopy of all docs. I am having sim card and visiting card. I have left without notice. Is any legal action can be taken from employer. They are asking me to present but I do not want and willing to return sim and card through courier. please suggest me.
Why do you want to run away from the company without informing them and handing over their visiting card and simply card. This will amount to breach of trust as you have also not given them any notice of your intention of not continuing with the job.
Off course they can initiate a legal action against you for breach of contract as you did not observe the notice period and abruptly left the co. They can very well institute a case against you and claim damages apart from recovering a month's salary in lieu of not observing the notice period. Also, did you sign any bond with the co. ? Yes, you can return the company's belonging by post if you don't wish to turn up before them.
