Can a case be filed against a client when no agreement is signed
18-Aug-2023 (In Labour & Service Law)
As a freelance digital marketer I was handling one client account for last few months (Of a Hospital) I used to handle their social media, google my business and local listing for dr plus various tasks as they need including video work and post-production. Started it as prepaid service I used to take service charge in advance and do the work but slowly they delayed the payment and started paying very late, as their accounts department told me "Fund shortage" an excuse. But from last 3 months, they had not paid me the service charge. As I enquired their MD (Medical director, owner of the hospital) has told me they didn't need my service and denied payment. but I still have control over their digital media accounts like facebook page google listings, the wource file of video works done, etc through which some of the other work done till last month end(provable). My question is do I stand a chance to win the case in this scenario if I don't have written contract or agreement?
Hi, With regard to your query though it is suggested to have a written contract or agreement for delivery of services or engagement of work. However the contract can be even an oral agreement wherein there is acceptance and proposal between the service provider and customer with clear noticeable performances. If you have the email exchanges between you both then that would be sufficient to place on record to the court to prove the case. Kindly contact and advocate to take up the matter.
